These Terms of Service (“Terms”) govern access to and use of Cognova Labs websites, apps, and services (“Services”). By creating an account, downloading an app, or otherwise using the Services, you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.

You retain ownership of content you submit (text, images, projects). By uploading content, you grant Cognova a non-exclusive, worldwide, royalty-free license to host, process, and display that content solely to operate the Services. Feedback or suggestions may be used without restriction.
The Services, including all software, interfaces, designs, and trademarks, are owned by Cognova Labs or our licensors. Except for the limited rights expressly granted, no license or transfer of intellectual property rights is implied.
Some features integrate third-party tools (e.g., cloud hosting, analytics, payment processors). Those services are governed by their own terms and privacy practices. Cognova Labs is not responsible for third-party content or actions.
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not guarantee uninterrupted or error-free operation.
To the fullest extent permitted by law, Cognova Labs and its affiliates are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or lost profits, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Services is limited to the amount you paid to use the Services in the twelve (12) months preceding the claim (or AUD $100 if no fees were paid).
You agree to defend, indemnify, and hold harmless Cognova Labs, its directors, employees, and partners from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Services, your content, or violation of these Terms.
These Terms are governed by the laws of Queensland, Australia, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Brisbane, Queensland, and you consent to their jurisdiction. Where required by law, you may have additional rights or alternative dispute mechanisms.
We may suspend or terminate access if you violate these Terms, create security risks, or cause harm to other users. Upon termination, the rights and licenses granted to you will cease, but sections relating to intellectual property, disclaimers, liability, and dispute resolution will survive.
